Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and TYSM, Inc. (“TYSM,” “we,” “us”) and govern your use of the TYSM website and services (the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What TYSM is

TYSM lets you claim a personal link (for example, tysm.to/yourname) so that anyone can send you a thank-you payment — a tip, support, or a note — in U.S. dollars. Payments are processed by our payment partner, Stripe. TYSM is not a bank, money transmitter, or custodian, and we never take possession of your funds. Money flows from the payer through Stripe directly to your connected Stripe account and your linked bank account.

2. Eligibility

You must be at least 18 years old and able to form a binding contract. To receive payouts, you must complete identity verification through Stripe and keep that information accurate. You are responsible for complying with all laws that apply to you, including tax obligations on amounts you receive.

3. Your account

You sign in through our authentication provider, Supabase. You are responsible for activity that occurs under your account and for keeping your sign-in method secure. Notify us promptly of any unauthorized use.

4. Handles

Handles are claimed on a first-come, first-served basis. A handle grants you a limited, revocable license to use that address within TYSM — you do not own it. We may reclaim, suspend, or reassign a handle that, in our reasonable judgment:

  • impersonates a person, brand, or organization;
  • infringes a trademark or other right;
  • is used for unlawful, fraudulent, or abusive purposes;
  • violates these Terms; or
  • has been dormant for an extended period.

5. Payments and fees

  • Processor. Payments are processed by Stripe via Stripe Connect. By receiving payments, you also agree to the Stripe Connected Account Agreement.
  • Non-custodial. Funds move from the payer through Stripe to your connected Stripe account and bank. TYSM never holds, controls, or has access to your funds.
  • Card data. Card and bank details are entered with and handled entirely by Stripe. TYSM never receives or stores them.
  • Platform fee. TYSM charges a platform fee (currently 1% of each payment). The payer covers processing and platform fees so that you receive the full intended amount. Fees may change with reasonable notice.
  • Payouts. Stripe pays out to your bank account on its payout schedule.
  • Refunds and chargebacks. Thank-you payments are voluntary and generally non-refundable. Refunds, disputes, and chargebacks are governed by the Stripe agreement; related amounts and fees may be deducted or recovered from you.

6. Paying as a guest

Anyone may send a thank-you without creating an account. If you make a payment, these Terms and our Privacy Policy apply to you, and you confirm that you are authorized to use the payment method.

7. Acceptable use

You agree not to use the Service to:

  • break the law or facilitate fraud, money laundering, or illegal transactions;
  • impersonate others or misrepresent your affiliation;
  • operate a business or activity prohibited by Stripe or applicable law;
  • infringe intellectual property or privacy rights;
  • post unlawful, hateful, harassing, or abusive content; or
  • circumvent fees, security, or access controls.

8. Your content

You keep ownership of the content you provide (such as your display name, bio, photo, and notes). You grant TYSM a non-exclusive, worldwide, royalty-free license to host and display that content as needed to operate the Service. You are responsible for your content and confirm you have the rights to it. Your handle, display name, bio, photo, and thank-you receipts are public by design.

9. Third-party services

The Service relies on third parties, including Stripe (payments) and Supabase (authentication). Your use of those services is also governed by their respective terms and privacy policies.

10. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure.

11. Limitation of liability

To the fullest extent permitted by law, TYSM will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability arising out of or relating to the Service will not exceed the greater of the platform fees you paid to us in the twelve months before the claim or USD $100.

12. Indemnification

You agree to indemnify and hold TYSM harmless from claims, losses, and expenses arising from your use of the Service, your content, or your violation of these Terms or applicable law.

13. Suspension and termination

We may suspend or terminate your access if you violate these Terms or to protect the Service or its users. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance.

15. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. The exclusive venue for disputes will be the state and federal courts located in Delaware, unless applicable law requires otherwise.
