1. Acceptance of Terms

By accessing or using TYSM ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access or use our Service.

These Terms apply to all visitors, users, and others who access or use the Service, including users who send or receive gratitude transactions.

By creating an account or using TYSM, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Description of Service

What TYSM Is

TYSM is a platform that enables users to express gratitude through meaningful transactions. We provide the infrastructure for sending, receiving, and tracking gratitude in digital form.

  • Transaction Processing: Send and receive gratitude with monetary value
  • Profile Management: Maintain your gratitude identity and history
  • Privacy Controls: Decide what aspects of your gratitude are public or private

What TYSM Is Not

  • Not a bank: We are not a financial institution or money service business
  • Not investment advice: TYSM is for gratitude expression, not financial planning
  • Not a social media platform: While social, our focus is meaningful gratitude
  • Not anonymous: Transactions require verified identities for legal compliance

3. User Accounts

Account Creation

  • Age Requirement: You must be at least 13 years old to use TYSM
  • Accurate Information: Provide truthful and complete information during registration
  • One Account: Maintain only one account per person
  • Unique Handle: Choose a handle that doesn't infringe on others' rights

Account Security

You are responsible for maintaining the security of your account and all activities under it.

  • • Keep your email account secure (we use magic links for authentication)
  • • Don't share access to your TYSM account with others
  • • Notify us immediately of any unauthorized use
  • • Log out from shared or public devices

4. Financial Transactions

Transaction Processing

TYSM facilitates gratitude transactions between users. All financial processing is handled by our payment partner, Stripe.

  • Payment Methods: Credit cards, debit cards, and bank transfers (where available)
  • Processing Time: Most transactions are instant, some may take 1-3 business days
  • Transaction Limits: We may impose limits for security and compliance reasons
  • Fees: Standard payment processing fees apply (disclosed before each transaction)

Refunds and Disputes

Gratitude Transaction Policy

Gratitude transactions are generally final once sent, as they represent genuine appreciation between users.

  • Technical Errors: We'll investigate and resolve technical transaction failures
  • Unauthorized Transactions: Report immediately for investigation
  • Fraudulent Activity: We'll work with you and payment processors to resolve
  • Disputes: Contact support within 60 days of the transaction

Tax Responsibilities

You are responsible for determining and paying any applicable taxes on gratitude received through TYSM. We may provide transaction records to assist with your tax obligations, but we do not provide tax advice.

5. Acceptable Use Policy

Platform Abuse

  • • Reverse engineering our service
  • • Automated or bot usage

Commercial Misuse

  • • Gambling or betting
  • • Investment schemes
  • • Circumventing transaction fees

6. Intellectual Property

TYSM's Rights

TYSM owns all rights to the service, including our software, design, trademarks, and other intellectual property.

  • • The TYSM name, logo, and branding are our trademarks
  • • Our software and algorithms are proprietary
  • • You may not copy, modify, or reverse engineer our service
  • • We grant you a limited license to use TYSM as intended

Your Content

You retain ownership of content you create on TYSM (profile information, transaction notes, etc.).

By using TYSM, you grant us a limited license to:

  • • Display your content as part of the service
  • • Store and process your content to provide TYSM
  • • Create anonymized analytics and insights
  • • Comply with legal obligations

This license ends when you delete your content or account.

7. Privacy and Data Protection

Your privacy is fundamental to TYSM. Our Privacy Policy explains how we collect, use, and protect your information.

By using TYSM, you also agree to our Privacy Policy, which is incorporated into these Terms by reference.

  • • Check our status page for real-time service information

Service Modifications

We may modify, update, or discontinue features of TYSM at any time.

  • • Continued use after changes constitutes acceptance

To the maximum extent permitted by law, TYSM's liability is limited to the amount you paid us in the 12 months before the claim.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or data.

11. Governing Law and Disputes

Governing Law

These Terms are governed by the laws of the State of California and the United States, without regard to conflict of law principles.

Dispute Resolution

We prefer to resolve disputes amicably. Please contact us first at support@tysm.to.

If informal resolution fails, disputes will be resolved through binding arbitration in San Francisco, California, except for claims that may be brought in small claims court.

12. Changes to These Terms

We may update these Terms from time to time to reflect changes in our service, legal requirements, or business practices.
